Grover Group GmbH, Potsdamer Str. 125, 10783 Berlin, Germany, and its affiliates, in particular Grover Deutschland GmbH, offer promotions from time to time on its website, on LinkedIn, Instagram, Facebook, or other social media, among other places. Participation in these promotions is governed by the following general conditions of participation.

Die Grover Group GmbH, Potsdamer Str. 125, 10783 Berlin, Deutschland, und ihre verbundenen Unternehmen, insbesondere die Grover Deutschland GmbH, bieten von Zeit zu Zeit Werbeaktionen auf ihrer Website, auf LinkedIn, Instagram, Facebook oder anderen sozialen Medien an, unter anderem. Die Teilnahme an diesen Aktionen unterliegt den folgenden allgemeinen Teilnahmebedingungen.

1. Promotion and Organizer

The Organizer of the promotion is Grover Group GmbH, Potsdamer Str. 125, 10783 Berlin, Germany (hereinafter referred to as the "Organizer"). Participation is governed exclusively by the following conditions of participation.

Veranstalter der Aktion ist die Grover Group GmbH, Potsdamer Str. 125, 10783 Berlin, Deutschland (im Folgenden „Veranstalter“ genannt). Die Teilnahme richtet sich ausschließlich nach den nachfolgenden Teilnahmebedingungen.

2. Participation

Any natural person who has reached the age of 18 and fully complies with the respective conditions of participation is eligible to participate. However, employees of the Organizer and their direct relatives are excluded from participation. Any resident of Germany who receives the email invitation and completes the survey is eligible to participate.Participation in the competition is only possible during the Promotion Period, which runs from Monday, June 2, 2025 (00:01 CET) to Sunday, June 15, 2025 (23:59 CET).Participation is completely free of charge and does not require the purchase of any goods or services to achieve entry. Incorrect information or incomplete entries will not be considered.

2. Teilnahme

Teilnahmeberechtigt ist jede natürliche Person, die das 18. Lebensjahr vollendet hat und die jeweiligen Teilnahmebedingungen vollständig erfüllt. Mitarbeiter des Veranstalters und deren direkte Angehörige sind von der Teilnahme ausgeschlossen. Teilnahmeberechtigt sind alle Personen mit Wohnsitz in Deutschland, die die per E-Mail versendete Umfrage erfolgreich ausfüllen. Die Teilnahme am Gewinnspiel ist nur während des „Aktionszeitraums“ möglich, der vom Montag, 2. Juni 2025 (00:01 Uhr CET) bis zum Sonntag, 15. Juni 2025 (23:59 Uhr CET) läuft.Die Teilnahme ist kostenlos und erfordert nicht den Kauf von Waren oder Dienstleistungen. Falsche oder unvollständige Angaben sowie verspätete Einsendungen werden nicht berücksichtigt.

3. Prize and Winner Selection

This promotion awards one (1) winner a free iPhone rental for one year.The winner will be randomly selected and will be notified via email and provided with further instructions on how to claim the prize.By accepting the Prize, the winner acknowledges and agrees to the Grover Terms and Conditions.

Dieses Gewinnspiel vergibt einem (1) Gewinner eine kostenlose iPhone-Miete für ein Jahr.Der Gewinner wird zufällig ausgewählt und per E-Mail benachrichtigt und erhält weitere Anweisungen zur Einlösung ihres Preises.Mit der Annahme des Preises erkennt der Gewinner an, dass er/sie den Allgemeinen Geschäftsbedingungen von Grover zustimmt.

4. Additional Prize Conditions

The Prize consists of an Apple iPhone 16 Pro Max - 256GB rental for one year, free of charge.The Prize is non-transferable, non-exchangeable, and non-refundable.If the prize cannot be made available for any reason, the Organizer reserves the right to provide a substitute prize of equal value.

4. Zusätzliche Preisbedingungen

Der Preis besteht aus einer kostenlosen Apple iPhone 16 Pro Max - 256GB Miete für ein Jahr.Der Gewinn ist nicht übertragbar, nicht umtauschbar und nicht erstattungsfähig.Sollte der Preis nicht verfügbar sein, behält sich der Veranstalter das Recht vor, einen gleichwertigen Ersatzpreis zu vergeben.

5. Exclusion from Participation

a) In the event of a breach of these conditions of participation, the Organizer reserves the right to exclude participants from the competition.b) Furthermore, the Organizer reserves the right to exclude participants who use unauthorized aids or otherwise obtain advantages through manipulation, for example through collective or multiple entries. This is the case, for example, if automatic scripts, hacking tools, Trojans or viruses are used, or if a participant obtains an advantage through other unauthorized means. Furthermore, untruthful personal data, as well as the use of "fake profiles" can lead to exclusion. In such cases, winnings may also be subsequently withdrawn and/or reclaimed.

5. Ausschluss von der Teilnahme

a) Bei einem Verstoß gegen diese Teilnahmebedingungen behält sich der Veranstalter das Recht vor, Teilnehmer vom Gewinnspiel auszuschließen.b) Der Veranstalter behält sich ferner vor, Teilnehmer auszuschließen, die sich unerlaubter Hilfsmittel bedienen oder sich anderweitig durch Manipulationen, z.B. durch Sammel- oder Mehrfachanmeldungen, Vorteile verschaffen. Dies ist z.B. der Fall, wenn automatische Skripte, Hacking-Tools, Trojaner oder Viren verwendet werden, oder wenn ein Teilnehmer sich auf andere unzulässige Weise einen Vorteil verschafft. Außerdem können unwahre Angaben zur Person sowie die Verwendung von „Fake-Profilen“ zum Ausschluss führen. In solchen Fällen können Gewinne auch nachträglich entzogen und/oder zurückgefordert werden.

6. Early Termination or Modification of the Competition

The Organizer is entitled to prematurely terminate, suspend or modify the raffle if unforeseen circumstances beyond the Organizer's control occur that make the original implementation more difficult or unreasonable for the Organizer. This includes in particular, but is not limited to, the unauthorized intervention of third parties, technical problems with hardware and software that are beyond the control of the Organizer, as well as violations of rights that are directly related to the implementation of the competition, in this case in particular the manipulative intervention in the course of the competition.

6. Vorzeitige Beendigung oder Änderung des Gewinnspiels

Der Veranstalter ist berechtigt, das Gewinnspiel vorzeitig zu beenden, auszusetzen oder zu ändern, wenn unvorhergesehene, vom Veranstalter nicht zu vertretende Umstände eintreten, die die ursprüngliche Durchführung erschweren oder für den Veranstalter unzumutbar machen. Hierzu zählen insbesondere, aber nicht ausschließlich, unbefugte Eingriffe Dritter, technische Probleme mit Hard- und Software, die außerhalb des Einflussbereichs des Veranstalters liegen, sowie Rechtsverletzungen, die in unmittelbarem Zusammenhang mit der Durchführung des Gewinnspiels stehen, hier insbesondere der manipulative Eingriff in den Ablauf des Gewinnspiels.

8. Liability of the Organizer

The following exclusions and limitations of liability apply to the Organizer and its affiliates’ (in particular, Grover Deutschland GmbH) liability for damages, without prejudice to the other legal requirements for claims:a) The Organizer shall be liable without limitation insofar as the cause of the damage is based on intent or gross negligence.b) Furthermore, the Organizer shall be liable for breaches of essential obligations caused by slight negligence, the breach of which jeopardizes the achievement of the purpose of the contract, or for breaches of obligations, the fulfillment of which is essential for the proper execution of the competition and on the fulfillment of which the contractual partners regularly rely. However, the scope of liability for the Organizer in such a case shall be limited to the foreseeable damage typical for the contract.c) The Organizer is not liable for the slightly negligent violation of other obligations than those mentioned above.d) The designated limitations of liability shall not apply in the event of injury to life, limb or health, for a defect following the assumption of guarantees for the quality of a product and in the event of fraudulently concealed defects. The liability according to the product liability law remains unaffected.e) The exclusion or limitation of liability of the Organizer shall also apply to the personal liability of representatives and vicarious agents of the Organizer or its employees.

8. Haftung des Veranstalters

Für die Haftung des Veranstalters und der mit ihm verbundenen Unternehmen (insbesondere der Grover Deutschland GmbH) auf Schadensersatz gelten unbeschadet der sonstigen gesetzlichen Anspruchsvoraussetzungen die folgenden Haftungsausschlüsse und -beschränkungen:a) Der Veranstalter haftet unbeschränkt, soweit die Schadensursache auf Vorsatz oder grober Fahrlässigkeit beruht.b) Darüber hinaus haftet der Veranstalter für leicht fahrlässig verursachte Verletzungen wesentlicher Pflichten, deren Verletzung die Erreichung des Vertragszwecks gefährdet, oder für die Verletzung von Pflichten, deren Erfüllung die ordnungsgemäße Durchführung des Wettbewerbs überhaupt erst ermöglicht und auf deren Einhaltung die Vertragspartner regelmäßig vertrauen. Der Umfang der Haftung des Veranstalters ist in einem solchen Fall jedoch auf den vertragstypischen, vorhersehbaren Schaden begrenzt.c) Der Veranstalter haftet nicht für die leicht fahrlässige Verletzung anderer als der vorgenannten Pflichten.d) Die genannten Haftungsbeschränkungen gelten nicht bei Verletzung von Leben, Körper oder Gesundheit, für einen Mangel nach Übernahme einer Garantie für die Beschaffenheit eines Produktes und bei arglistig verschwiegenen Mängeln. Die Haftung nach dem Produkthaftungsgesetz bleibt hiervon unberührt.e) Der Ausschluss oder die Begrenzung der Haftung des Veranstalters gilt auch für die persönliche Haftung der Vertreter und Erfüllungsgehilfen des Veranstalters oder seiner Mitarbeiter.

9. Final Provisions

The English translation is provided for convenience only, the German version shall prevail. The law of the Federal Republic of Germany, and the place of jurisdiction of Berlin, Germany, shall apply to the exclusion of international private law and the UN Convention on Contracts for the International Sale of Goods (CISG).

9. Schlussbestimmungen

Die englische Fassung dient allein dem leichteren Verständnis, lediglich die deutsche Fassung ist bindend. Es gilt das Recht der Bundesrepublik Deutschland mit dem Gerichtsstand Berlin unter Ausschluss des internationalen Privatrechts und des UN-Kaufrechts (CISG).
